Terms & Conditions

 

The Client availing services from Happy Monk Holidays LLP (“HMH”) shall be deemed to have read, understood and expressly accepted these terms and conditions which shall govern the desired transaction or provision of services by HMH for all purposes, and shall be binding on the Client. All rights and liabilities of the Client and/or HMH with respect to any services to be provided by HMH shall be restricted to the scope of these terms and conditions. 

Additionally, the Service Provider itself may provide terms and guidelines that govern particular features, offers or the operating rules and policies applicable to each Service (for example, flights, hotel reservations, packages, etc.). The Client shall be responsible for ensuring compliance with the terms, operating rules and policies of the Service Provide including terms and conditions set forth in a Service Providers’ fare rules, contract of carriage or other rules.

HMH’s Services are offered to the Client conditioned on acceptance without modification of all the terms and conditions. If the Client does not agree to these terms and conditions, the Client may not access or otherwise use these services. Continued use of the services indicates the acknowledgement that the Client has read, understood and accepted the terms and conditions.

Responsibility
HMH is not an agent of airlines, tour operators, cruise lines, lodging providers, car-rental companies, ground operators, railways and any other suppliers of travel services. We merely act as an agent for the client in acquiring travel services such as transportation, hotel accommodations, sightseeing and other privileges or services for the benefit of the clients. We are not to be held responsible for the acts or omissions of such suppliers or their subcontractors or their failure to provide services, adhere to their own schedules, or honour their contracts.

Force Majeure
The Client agrees that there can be exceptional circumstances where the service operators like the airlines, hotels, the respective transportation providers or concerns may be unable to honour the confirmed bookings due to various reasons like climatic conditions, labour unrest, insolvency, business exigencies, government decisions, operational and technical issues, route and flight cancellations etc. If HMH is informed in advance of such situations where dishonour of bookings may happen, it will make its best efforts to provide similar alternative to the Client or refund the booking amount after reasonable service charges, if supported and refunded by that respective service operators. The Client agrees that HMH being an agent for facilitating the booking services shall not be responsible for any such circumstances and the customers have to contact that service provider directly for any further resolutions and refunds.

Hazards
HMH does not claim to have any special knowledge regarding foreign entry requirements, unsafe conditions such as health or weather hazards, political instabilities, supplier insolvencies, or the suitability for disabled persons of any portion of any tour.  The Client hereby releases HMH from any claims resulting in whole or in part from any situation mentioned herein and any other conditions not within the control of HMH. HMH conducts an in-depth research for all elements of the package provided but that is limited to the extent of the knowledge of HMH.

Visa Requirements
Overseas travel bookings done by HMH are subject to the applicable requirements of Visa which must be obtained by each member of the Client’s group. While HMH may assist in Visa applications, it is not responsible for non-issue of Visa which would mean inability to travel and is not liable to refund for the untraveled bookings due to any such reason.

Refunds
The Client agrees that in situations due to any technical failures, services committed earlier may not be provided or may involve substantial modification. In such cases, HMH shall refund the entire amount received from the customer for availing such services minus the applicable cancellation, refund or other charges, which shall completely discharge any and all liabilities of HMH against such non-provision of services or deficiencies. Additional liabilities, if any, shall be borne by the Client.

Service Providers such as airlines, tour operators, cruise lines, railways, hotels, etc impose cancellation and schedule change penalties up to 100% in certain cases. Please review the applicable rules before making a reservation or alteration as we are not liable to reimburse for changes once a reservation has been made. Refunds of the services provided will be limited to the terms of individual Service Provider.

Delays
HMH shall not be liable for delays or inabilities in performance or non-performance in whole or in part of its obligations due to any causes that are not due to its acts or oversights and are beyond its reasonable control, such as acts of God, fire, strikes, embargo, acts of government, acts of terrorism or other similar causes, problems at airlines, rails, buses, hotels or transporters end. In such event, the Client affected will be promptly given notice as the situation permits.

Flight/train/bus delays are common phenomenon and if delayed for any reason, the airline/railway/operator is not required by law to pay for en route expenses, such as meals, hotels, taxis and phone calls. Please understand that these circumstances are outside our control. Compensations, if any, depend on the airlines or the travel insurance purchased by you.

Itinerary

A detailed itinerary will be sent to the client who purchases the full package for the holiday from HMH. If the client purchases only some component of the package, HMH is not liable to provide a detailed itinerary for the holiday.


Itinerary Check
Before reservations, HMH shall send the Client a final itinerary which the Client is liable to check thoroughly and ensure that it is correct as to dates, times, fares, and rates. The package Inclusions & Exclusions are also to be checked. Errors, if any, must be highlighted immediately. Changes or discrepancies bought to notice of HMH post confirming bookings will not be accepted and HMH will not be held liable for any damages or loss incurred.

Liability
Without prejudice to whatever is stated above, the comprehensive liability on part of HMH arising under any circumstances, in respect of any services, shall is limited to the price paid by the Client for the services less any cancellation, refund or others charges, as may be applicable. In no case the liability shall include any loss, damage or additional expense whatsoever beyond the amount charged by HMH for its services.

HMH is not responsible for any errors, omissions or representations on any of its pages or on any links or on any of the linked website pages.

Indemnification
The Client shall be solely and exclusively liable for any breach of any country specific rules and regulations or general code of conduct and HMH cannot be held responsible for the same.

Right to Refuse
HMH at its sole discretion reserves the right to not to accept any customer order without assigning any reason thereof. Any contract to provide any service by HMH is not complete until full money towards the service is received from the customer and accepted by HMH.

Information on Website
HMH and its logo is our trademark. Use of our logo and name without our explicit consent will amount to infringement and subsequent legal action. The content on this website is our property, unless specified otherwise, and you must not replicate, reproduce or use it without our consent. 

HMH may provide the Client with content such as photographs, graphics, video or material contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks, or other intellectual property rights and laws. The Client may use this material only as expressly authorized by HMH and shall not copy, transmit or create derivative works of such material without express authorization.

The Client acknowledges and agrees that he/she shall not upload post, reproduce, or distribute any content that is protected by copyright or other proprietary right of a third party without obtaining the written permission of the owner of such right.

Linked sites, if any, are not under the control of HMH and HMH is not responsible for the contents of any linked site. HMH provides such links only as a convenience and the inclusion of any link does not imply endorsement of the site by HMH.

The Client understands and agrees that any material and/or data downloaded or otherwise obtained through the use of the Service is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data. Nevertheless, HMH will always make its best endeavors to ensure that the content on its websites or other information channels are free of any virus or such other malwares.
